Scope
These terms apply to the elvixit.com website, the ElvixIT careers portal, the intern application and management system, and any other service that links to this policy. Separate written agreements (such as a master services agreement, statement of work, offer letter or internship letter) take precedence over these terms where there is a direct conflict on the matter being addressed; everything else in these terms continues to apply.
These terms do not apply to third-party websites that we may link to. Those services are governed by their own terms and privacy policies.
Account responsibility
Some parts of the services require you to create an account. By registering you agree to:
- Provide accurate, current and complete information, and keep it up to date.
- Use a strong, unique password and keep your credentials confidential. You are responsible for activity that takes place under your account.
- Notify us promptly at legal@elvixit.com if you suspect unauthorised access or any breach of security involving your account.
- Use the account only for yourself; you may not transfer it to another person.
We may suspend or close an account that we reasonably believe is being used in breach of these terms, after notice where practicable.
Acceptable use
You agree not to use the services in any way that is unlawful, fraudulent, harmful, or harmful to others. In particular, you agree not to:
- Submit false or misleading information, including fabricated qualifications, work history or identity details.
- Submit content that infringes intellectual property rights, is defamatory, obscene, discriminatory, or otherwise unlawful.
- Attempt to gain unauthorised access to any account, system, or data, including by probing, scanning, or testing vulnerabilities without our written consent.
- Interfere with the integrity or availability of the services, including through denial of service, rate-limit evasion, or automated scraping of non-public content.
- Reverse engineer, decompile or otherwise attempt to derive the source code of any non-public software made available through the services.
- Use the services to send unsolicited commercial communications or to harvest contact information.
Applications, jobs and internships
The careers portal lets you apply for advertised jobs and internships. Submitting an application creates no employment or contractual relationship. Specifically:
- We make no guarantee of shortlisting, interview, offer or selection. Hiring decisions remain at our sole discretion and are based on role requirements and candidate fit.
- Listings and stipend or salary information are accurate at the time of publication. Roles can be withdrawn or modified without notice; only a signed offer or internship letter creates an obligation.
- You confirm that the material you submit is your own work and that you have the right to share any third-party content included in it (for example, portfolio pieces).
- You grant us a limited, non-exclusive licence to review, store, process and share your application material with the interviewers, mentors and clients involved in evaluating your candidacy.
- For internship offers, additional terms (including stipend schedule, intellectual property, confidentiality and conduct expectations) are set out in the internship letter and program handbook.
Intellectual property
All material on the website and the portal — including text, graphics, design elements, source code, logos and the “ElvixIT” name — is owned by ElvixIT or its licensors and is protected by Indian and international intellectual property laws. You are granted a limited, non-exclusive, non-transferable right to access and use the services for their intended purpose; no other rights are granted.
You retain ownership of the material you submit (such as your resume and portfolio). By submitting it, you grant us the licence described in section four. Work product created during a paid engagement or internship is governed by the relevant statement of work or internship letter.
Feedback you choose to share about the services may be used by us without obligation or compensation, on a perpetual and worldwide basis.
Third-party services
The services rely on a small number of third-party providers, including Hostinger for some operational tooling and Amazon Web Services for cloud infrastructure. By using the services, you accept that:
- Availability and performance of the services can be affected by third-party outages or changes outside our control.
- Third-party providers operate under their own terms and privacy policies. We select providers that maintain industry-standard security and data protection commitments.
- Where the services link to external websites, we are not responsible for their content, policies or practices.
Disclaimer of warranties
The services are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.
We do not warrant that the services will meet your specific requirements, that defects will be corrected, or that the services will be free of viruses or other harmful components, other than the security measures described in our privacy policy. Content provided through the services is for general informational purposes and is not professional advice.
Limitation of liability
To the maximum extent permitted by law, ElvixIT and its directors, employees and affiliates will not be liable for any indirect, incidental, special, consequential, punitive or exemplary damages, including loss of profits, loss of data, loss of goodwill, or business interruption, arising out of or in connection with your use of the services.
Our aggregate liability for any claim arising out of or relating to the services will not exceed the greater of (a) the amount you have paid to ElvixIT in the twelve months preceding the event giving rise to the claim, or (b) five thousand Indian rupees. This limitation applies whether the claim is based on contract, tort, statute or any other legal theory.
Nothing in these terms limits liability for matters that cannot be excluded under applicable law, including fraud and gross negligence.
Indemnification
You agree to indemnify and hold ElvixIT, its directors, employees and affiliates harmless from and against any claims, damages, losses, liabilities and reasonable expenses (including attorneys’ fees) arising out of (a) your breach of these terms, (b) your violation of any law or third-party right, or (c) any content you submit through the services. We will notify you promptly of any such claim and cooperate reasonably in its defence.
Termination
You may stop using the services at any time and request that your account be closed. We may suspend or terminate your access, with or without notice, if we reasonably believe that you have breached these terms, that continued access poses a security or legal risk, or that we are required to do so by law. On termination, the sections of these terms that by their nature should survive — including intellectual property, disclaimer, limitation of liability, indemnification, governing law and dispute resolution — will continue to apply.
Termination does not affect the parties’ rights and obligations under any separately signed agreement, including statements of work, offer letters or internship letters.
Governing law and jurisdiction
These terms and any dispute arising out of or in connection with them are governed by the laws of India, without regard to its conflict of laws principles. The courts located in Hyderabad, Telangana have exclusive jurisdiction over any such dispute, except that we may seek injunctive or equitable relief in any competent court to protect our intellectual property or confidential information.
Before initiating formal proceedings, the parties agree to make a good-faith attempt to resolve the dispute through written notice and a thirty-day discussion period.
Changes to these terms
We may update these terms from time to time. The “Last updated” date at the top of the page reflects the most recent revision. Substantive changes will be notified through the website and, where appropriate, by email to active account holders at least fifteen days before they take effect. Your continued use of the services after a change takes effect constitutes acceptance of the revised terms.
